In the middle of the night, without a hearing or debate, friends
of the big drug companies have plans to slip a proposal through
Congress that would award special interest protections to the pharmaceutical
industry and place the health and safety of the American people
at risk.
No Accountability
The proposal would allow drug companies to avoid being held accountable
if their products cause injury or even death, even in cases of gross
negligence. Under the guise of protecting vaccine producers, the
proposal would allow drug companies special protections not only
for vaccines and drugs intended to combat pandemic flu, but also
a broad range of drugs totally unrelated to a pandemic, including
Tylenol, Advil and Vioxx.

Secret Underhanded Methods
If this legislation is truly necessary, why is Congress trying
to push it through in secret, rather than having an open debate
on the House or Senate floor? This is an effort to take advantage
of the climate of fear over pandemic diseases, and could let the
drug industry get away with murder. It would not protect the health
of our citizens.

Lawsuits Not Harming Vaccine Production
The drug industry and its friends will tell you that litigation
has caused a crisis in vaccine production - BUT IT'S JUST NOT TRUE!
In fact, public health officials at the National Institutes
of Health, Centers for Disease Control and National Vaccine Advisory
Committee all say that liability concerns have little or no impact
on vaccine production - and right now, manufacturers are lining
up to get licenses to produce the vaccine Tamiflu.

Reverse Effect
In addition to preventing injured families from seeking just
compensation, it could actually make a pandemic worse by discouraging
Americans from getting vaccinated. When Congress passed similar
smallpox vaccine legislation, many first responders simply refused
to get vaccinated.
